These terms and conditions apply to the BananaCal app (hereby referred to as "Application") for macOS that was created by Howon Kim (hereby referred to as "Service Provider") as a paid service.
Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application. Unauthorized copying or modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.
The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application at any time and for any reason. Any changes to the Application, including new features or modifications to existing ones, will be made available through the Mac App Store update mechanism.
License
The Service Provider grants you a personal, non-transferable, non-exclusive license to use the Application on any macOS device that you own or control, subject to these Terms and Conditions and the Mac App Store Terms of Service. This license does not allow you to distribute or make the Application available over a network where it could be used by multiple devices at the same time.
Calendar Data
The Application accesses your calendar data through the macOS EventKit framework to provide its core functionality. You are responsible for ensuring that you have the right to access and manage the calendar data you use with the Application. The Service Provider is not responsible for any loss or modification of calendar events made through the Application.
Third-Party Services
The Application uses Apple system frameworks including EventKit and MapKit, which are subject to Apple's own Terms and Conditions. Below are links to the relevant terms:
Disclaimer of Warranties
The Application is provided "AS IS" without warranty of any kind. The Service Provider does not warrant that the Application will be uninterrupted or error-free, that defects will be corrected, or that the Application is free of viruses or other harmful components.
The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying on the functionality of the Application, including but not limited to loss or inaccuracy of calendar data.
Your Responsibilities
You are responsible for maintaining your device and ensuring it meets the minimum system requirements for the Application (macOS 14.0 or later). The Service Provider cannot be held responsible if the Application does not function correctly due to an incompatible operating system version or device configuration.
It is your responsibility to keep regular backups of your calendar data. While the Application interacts with your calendar data through Apple's secure EventKit framework, the Service Provider is not liable for any data loss that may occur.
Updates and Termination
The Service Provider may release updates to the Application from time to time. While the Application is designed to remain compatible with current versions of macOS, the Service Provider does not guarantee compatibility with all future operating system releases. You agree to install updates when offered to ensure the best experience and security.
The Service Provider reserves the right to discontinue the Application at any time. Upon termination, the rights and licenses granted to you in these terms will end, and you must cease using the Application.
Changes to These Terms
The Service Provider may periodically update these Terms and Conditions. You are advised to review this page regularly for any changes. Continued use of the Application after any changes are posted constitutes your acceptance of those changes.
